Mobile App Terms Addendum
BLACK PANTERA LLC
Effective Date: October 2026
1. Relationship to the Main Terms
This Addendum supplements the Black Pantera Terms of Use published at blackpantera.com/policies/terms-of-service (the "Main Terms"). It governs your use of the Black Pantera mobile application distributed through the Apple App Store and the Google Play Store (the "App").
Where this Addendum is silent, the Main Terms govern. Where this Addendum expressly addresses App-specific matters, this Addendum controls for the App.
Terms not defined here have the meaning given in the Main Terms.
2. Acceptance
By downloading, installing, or using the App, you accept this Addendum and the Main Terms in full. If you do not agree, do not download or use the App and delete it from your device.
Downloading the App from the Apple App Store or the Google Play Store additionally binds you to the applicable app store operator's terms (Apple Media Services Terms and Conditions or Google Play Terms of Service), which govern the transaction between you and the app store.
3. Age restriction
The App is licensed exclusively to adults 18 years of age or older. Section 2 of the Main Terms applies to the App without modification.
The App is rated 17+ in the Apple App Store and Mature 18+ in the Google Play Store due to intimate wellness themes and adult content. By using the App you affirm that you are of legal age in the jurisdiction from which you access the App and that no local law prohibits your access to intimate wellness content of the nature offered.
4. Nature of the App
The App provides audio experiences designed for adult intimate presence and body awareness. The content is editorial and reflective in nature, not medical, therapeutic, clinical, or diagnostic.
Section 3 of the Main Terms (Nature of Products and Assumption of Risk) and Section 16 (No Medical or Therapeutic Claims) apply to the App content in full. You voluntarily assume all risks associated with your use of the App, including any physical, emotional, or subjective response to the audio content.
The App is not a substitute for professional medical, psychological, or sexual health advice.
5. License grant
Subject to your compliance with this Addendum and the Main Terms, Black Pantera LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a mobile device you own or control, for your personal, non-commercial use only.
This license does not authorize:
- Copying, modifying, adapting, translating, or creating derivative works from the App or any of its content
- Reverse engineering, disassembling, decompiling, or attempting to derive the source code of the App
- Renting, leasing, lending, selling, sublicensing, distributing, or otherwise transferring the App or your license
- Removing, obscuring, or altering any proprietary notices, labels, or watermarks
- Extracting, recording, re-encoding, or sharing the audio content of the App by any means, including screen capture, audio capture, screen recording, or streaming to third parties
- Using the App or its content on any platform that competes with Black Pantera LLC
- Using the App in connection with any commercial activity, including public performance, streaming, monetized broadcast, or the training of machine learning or artificial intelligence systems
All rights not expressly granted are reserved by Black Pantera LLC. Section 7 (Intellectual Property Ownership) and Section 8 (Limited License) of the Main Terms apply to the App in full.
6. In-App content ownership
All audio recordings, voice performances, music tracks, texts, images, logos, and design elements within the App are owned by or licensed to Black Pantera LLC and protected by U.S. and international intellectual property laws. Nothing in this Addendum transfers ownership to you.
You may listen to, view, and interact with the content on your device solely through the App's intended user interface, for your personal use, during the time your license is active.
7. Apple App Store provisions
If you obtained the App from the Apple App Store, the following additional terms apply as required by Apple Inc.:
a. Acknowledgment. This Addendum and the Main Terms are between you and Black Pantera LLC. Apple Inc. is not a party to this agreement and has no obligation to provide any maintenance and support services with respect to the App.
b. Scope of License. The license granted to you in Section 5 is limited to a non-transferable license to use the App on any Apple-branded product that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
c. Maintenance and Support. Black Pantera LLC is solely responsible for providing any maintenance and support services with respect to the App, as required under applicable law. You acknowledge that Apple Inc. has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
d. Warranty. Black Pantera LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
e. Product Claims. You and Black Pantera LLC acknowledge that Black Pantera LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of the App, including without limitation product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
f. Intellectual Property Rights. In the event of a third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Black Pantera LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
g. Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
h. Third-Party Beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Addendum, and that upon your acceptance of this Addendum, Apple will have the right (and will be deemed to have accepted the right) to enforce this Addendum against you as a third-party beneficiary of it.
i. EULA. Black Pantera LLC has elected to use the Apple Standard End User License Agreement as the governing EULA for the App on iOS, supplemented by this Addendum and the Main Terms. Where the Apple Standard EULA and this Addendum conflict, the more protective provision for the user prevails.
8. Google Play provisions
If you obtained the App from the Google Play Store, the following additional terms apply:
a. Google Play Terms. Your use of the App is additionally governed by the Google Play Terms of Service and the Google Play Developer Distribution Agreement, as applicable.
b. Google Not a Party. Google LLC is not a party to this Addendum or the Main Terms. Black Pantera LLC is solely responsible for the App and its content.
c. Support. Support requests for the App must be directed to web@blackpantera.com. Google is not obligated to provide support.
9. Updates and versions
Black Pantera LLC may release updates, patches, or new versions of the App from time to time. Updates may be delivered through the Apple App Store or the Google Play Store and may be installed automatically depending on your device settings.
Continued use of the App after an update constitutes acceptance of the updated version. Black Pantera LLC is not obligated to maintain compatibility with all past versions of the App.
Older versions of the App may be discontinued at Black Pantera LLC's sole discretion. Discontinuation does not entitle you to any refund unless required by applicable consumer law.
10. No in-App purchases
At the effective date of this Addendum, the App does not offer in-app purchases, subscriptions, or paid content. Access to the App is provided under the terms of the app store transaction (free download).
If in-app purchases or subscriptions are added in the future, additional terms will be presented at the time of purchase and will incorporate Apple's or Google's respective in-app purchase requirements.
11. Acceptable use within the App
You agree to use the App only for its intended purpose. Prohibited conduct within or in connection with the App includes:
- Attempting to bypass the age verification affirmations, licensing restrictions, or security mechanisms of the App
- Modifying the App binary or any of its resources
- Distributing modified or reverse-engineered versions of the App
- Using the App on jailbroken, rooted, or otherwise modified operating systems in a manner that circumvents Apple's or Google's security model
- Capturing, recording, transcribing, or sharing App audio content in violation of the license granted in Section 5
- Using the App to harass, defame, or threaten any person
- Using the App content in any public performance, broadcast, or commercial context
- Using the App or its content as training data for any machine learning model, large language model, or artificial intelligence system
Violation of this Section is a material breach of this Addendum and the Main Terms and may result in termination of your license, removal of the App from your access, and legal action as described in the Main Terms.
12. Termination
Black Pantera LLC may terminate or suspend your license to the App at any time, with or without notice, for breach of this Addendum, the Main Terms, or any applicable law, or for abusive, fraudulent, or harmful conduct.
Upon termination, you must uninstall the App from all devices. All provisions of this Addendum and the Main Terms that by their nature should survive termination (including intellectual property, license restrictions, disclaimers, limitation of liability, indemnification, dispute resolution, arbitration, and class action waiver) will survive.
13. Disclaimer and limitation of liability
Section 17 (Disclaimer of Warranties) and Section 18 (Limitation of Liability) of the Main Terms apply to the App without modification. The App is provided "as is" without warranty of any kind.
Without limiting the foregoing, Black Pantera LLC is not liable for:
- Interruption, delay, or failure of the App caused by device incompatibility, operating system issues, network conditions, or third-party services
- Loss of local App data caused by device malfunction, operating system update, uninstall, or user action
- Any physical, emotional, or subjective response you experience from using the App content
- Any conduct or content of third parties, including content shared or discussed outside of the App
14. Indemnification
Section 19 (Indemnification) of the Main Terms applies to your use of the App in full.
15. Governing law, arbitration, and class waiver
Sections 22 through 26 of the Main Terms (Mandatory Internal Dispute Resolution, Binding Arbitration, Class Action Waiver, Jury Trial Waiver, and Governing Law and Venue) apply to any dispute arising out of or related to this Addendum or your use of the App, without modification.
For clarity, all disputes concerning the App will be resolved exclusively by binding arbitration in Miami-Dade County, Florida, on an individual basis, under Florida law and the Federal Arbitration Act.
16. Changes to this Addendum
Black Pantera LLC may modify this Addendum from time to time by posting an updated version at blackpantera.com/pages/mobile-app-terms-addendum and, where required by applicable law or app store policy, notifying users through the App Store or Google Play update notes.
Continued use of the App after a modification constitutes acceptance of the modified Addendum.
